Welcome to PROcheck properties ("Company," "we," "us," or "our"). By ordering our services or using our website, located at procheckproperties.com, you ("Client," "you," or "your") agree to these Terms of Service.
1. Scope of Services
  • Inspection Nature: We provide visual, non-invasive inspections of vacant homes and lots to identify visible, accessible issues.
  • No Technical Experts: Our inspections do not replace specialized trade checks. We do not perform structural engineering, detailed electrical testing, or certified pest control assessments.
  • Reporting: We deliver digital reports based solely on conditions visible at the exact date and time of our visit.
  • We Are Not: We're not a Property Management Company. We do not hold a real estate license in CA.  We do not manage tenants, collect rent , or lease properties.
  • We Are Not: We're not a Security Guard Service, our service is a visual inspection utility, not a security patrol. Our job is to discover and report issues, not to physically confront intruders.
2. Client Obligations and Access Authorization
  • Right of Entry: You warrant that you own the property or have explicit legal authority to grant us access to the home and lot.
  • Safe Access: You must ensure the property is safe for our inspectors. You must notify us of any known hazards like unstable structures, aggressive wildlife, or chemical spills.
  • Utility Status: You must inform us if utilities (water, electricity, gas) are turned on or off prior to our scheduled visit.
3. Limitation of Liability and "No-Guarantee" Policy
  • Hidden Defects: We are not liable for defects that are hidden, intermittent, unviewable, or locked behind inaccessible areas of the property.
  • Changes Post-Inspection: We are not responsible for events occurring after we leave the property. This includes subsequent break-ins, storm damage, or sudden pipe bursts.
  • Liability Cap: To the maximum extent permitted by law, our total liability for any errors, omissions, or negligence is strictly limited to a refund of the fee paid for that specific inspection.
4. Billing, Cancellations, and Fees
  • Payment Terms: Payment is due upfront upon booking / within 14 days of invoice].
  • Late Payments: Unpaid invoices accumulate interest at a rate of 1.5% per month.
  • Cancellation Window: You must cancel or reschedule at least 48 hours before the appointment to avoid a 20 Percentage] cancellation fee.
5. Intellectual Property and Report Usage
  • License to Client: Reports are generated solely for your personal use or internal business decisions regarding the property.
  • Third-Party Reliance: You may not distribute or sell our reports to third parties (such as buyers or insurers) without our written consent. We accept no liability to third parties who rely on our reports.
6. Hazardous Materials and Hazardous Environmental Conditions
  • No Mold/Asbestos Testing: Unless explicitly added as a premium certified service, our standard inspection does not test for mold, lead paint, radon, or asbestos.
  • Right to Refuse: We reserve the right to immediately terminate an inspection and leave the premises if we encounter unsafe structures, illegal activity, or hazardous bio-materials.
7. Governing Law and Dispute Resolution
  • Jurisdiction: These Terms are governed by the laws of California.
  • Arbitration: Any disputes arising from our services must first be submitted to mandatory, binding mediation or arbitration in Fresno or Clovis California before filing a lawsuit.
